1. Introduction

Welcome to Lutify — a product owned and operated by Othmane Nejdi, a Moroccan-based independent software creator. Lutify provides digital tools and services, including a Figma plugin and an online platform, designed to bring AI-powered image editing, presets, and enhancement tools directly into your design workflow.

By accessing or using any part of Lutify (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Service.

2. Services Overview

Lutify includes:

• A Figma plugin for AI-powered image editing (background remover, upscaler, presets, cropping, filters, etc.).
• AI generation tools to create and enhance images.
• A web-based platform to manage subscriptions, usage, and integrations.

The Service is provided on a subscription basis, with plan features and limits as described on the website.

3. Account Registration

To access most features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials. You agree to provide accurate and complete information during registration and to keep it updated.

4. Subscription & Billing

• Lutify subscriptions are managed and processed securely via Paddle, our Merchant of Record.
• You will be charged automatically based on the plan you select (monthly or yearly).
• You can cancel your subscription at any time. Your access will remain active until the end of the current billing cycle.
• Refunds are not guaranteed but may be issued at our discretion in case of service errors or system-wide issues.
• Invoices and receipts are issued by Paddle in accordance with your billing information.

5. Acceptable Use

You agree to use Lutify only for lawful purposes and in accordance with these Terms. You may not:

• Reverse-engineer, decompile, or modify the platform.
• Circumvent usage limits or abuse plan features.
• Share your account or tokens with others.
• Use Lutify to host or generate illegal, harmful, or offensive content.

6. Limits & Fair Use

Each subscription plan comes with defined limits (e.g., number of AI generations, edits per month). Abuse of these limits or attempts to exploit the system may result in suspension or termination of your account.

7. Intellectual Property

All content, code, and features of Lutify are owned by Othmane Nejdi. You may not reuse, resell, or redistribute any part of the Service without explicit written permission.

You retain full rights to your own design files, generated images, and content created through Lutify.

8. Data & Privacy

We collect minimal personal data (name, email, usage statistics) solely for the purpose of providing the Service. We do not sell or share your data with third parties outside of service providers (e.g., Paddle, analytics).

9. Availability & Disclaimer

Lutify is provided "as is" and "as available." While we strive to maintain high uptime and performance, we cannot guarantee uninterrupted service.

We disclaim all warranties, express or implied, and are not liable for:

• Business or design workflow losses due to downtime
• Compatibility issues with third-party plugins or tools
• Data loss or errors during image processing or export

10. Termination

• You may cancel your account at any time via the dashboard.
• We may suspend or terminate your access if you violate these Terms, abuse the system, or harm the integrity of the platform.

11. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes implies acceptance.
